An Oregon man who said he broke two teeth at an Outback Steakhouse after biting into some mashed potatoes is suing the restaurant for negligence, Newsmax reported.

Roger Branstetter filed a lawsuit in Multmonah County Circuit Court last week for $48,000, claiming that he cracked two molars on of broken porcelain that were in a serving of mashed potatoes at an Oregon Outback Steakhouse in Feb. 2012, Newsmax reported.

The lawsuit states that the managers "admitted to [Branstetter] that a plate had broken in the kitchen and that pieces had fallen into the mashed potatoes," The Oregonian reported.

Branstetter had to have the two teeth pulled and replaced with dental implants.

Jason Bender, a managing partner of the Evergreen Restaurant Group that owns the five-state franchise, told The Oregonian he had never heard of any other customer being hurt by pieces of fractured dishes in the food.

"It's really disappointing when someone gets hurt inside the restaurant," Bender said.

He added that the safety is very important to the restaurant.

The lawsuit said the group was negligent for not telling customers that a dish had broken and letting them "make their own informed decisions regarding whether to eat food that might contain sharp, hard, dangerous and potentially deadly pieces of broken plate," The Oregonian reported.
