University of Toledo Medical Center Denies Negligence Claims, After Botched Kindey Transplant, Asks Court to Dismiss Case
ByThe University of Toledo Medical Center (UTMC) has denied allegations of negligence from a family affected by a glaring mistake in a kidney transplant, the Associated Press reported.
UTMC admitted to a nurse accidentally throwing away a kidney to be used for Sarah A. Fudacz, a 24-year-old patient, in Aug. 2012 given by her younger brother. According to court records, she was diagnosed with end-stage renal disease and later received a kidney from Colorado.
UTMC paid for the flight to Colorado, but the brother and sister, along with their family, still filed a lawsuit against the hospital for negligence causing physical and emotional suffering and distress. UTMC has asked the Ohio Court of Claims to dismiss the case.
In the complaint, the parents said they were emotionally distressed because they worried for Fudacz's prognosis and that the brother had given a kidney for nothing. She also woke up in the operating room with no incision and feared her brother could have died in surgery.
The hospital did not comment on the lawsuit, but has since conducted an internal and external review. The nurse who accidentally disposed of the kidney has since retired. Another woman involved was suspended and fired, but has since filed a lawsuit for wrongful termination.
The doctor who conducted the procedure no longer operates renal transplants. UTMC's entire live kidney donation program, but has since resumed.
The eight family members who filed the suit are each asking for monetary damages of at least $25,000.
University chancellor and dean of the College of Medicine Dr. Jeffery P. Gold issued a statement after the fumbled transplant apologizing to the Fudacz family.
"We cannot fathom the disappointment that those impacted have experienced over the course of the last week," the statement read. "The university cannot begin to express the sorrow that we feel that this unfortunate incident occurred. We apologize sincerely."
