The Hays County district attorney's office dropped charges against a former Texas State University student, Brittany Henderson, who was accused of threatening to bomb the campus, past fall.

Hays County assistant district attorney, Fred Weber, told the Statesman that there wasn't sufficient evidence to proceed with the case against 19-year-old Henderson.

Instead, a federal criminal complaint has been issued against Henderson's ex-boyfriend, Dereon Kelley, for the same crime. He is accused of sending false threats using her e-mail account.

Kelly now faces up to 10 years in prison on a federal felony charge for accessing Henderson's email through his phone to send bomb threats to Texas State on Oct. 18 and Texas A&M University on Oct. 19.

Last year October, Henderson was arrested for making hoax bomb threat calls. She was accused of making a terrorist threat, a third-degree felony a false alarm or report and a Class A misdemeanor.

Two days after her arrest, the policemen arrested her ex-boyfriend as well. Kelly's arrest followed an investigation by the police after they traced a data trail that revealed his access to Henderson's email account.

Despite her ex-boyfriends' arrest she had to spend a month in jail before being released in December with a reduced bond.

John Quinn, Henderson's attorney told the newspaper that her client was relieved. They will decide next week whether to file a lawsuit relating to this case.
