Krysta Huft, a University of Idaho student, has filed a civil lawsuit against Delta Chi house- a national fraternity organization and its chapter at the university for serving her with alcohol at a party on campus in 2011 despite being underage and not verifying her ID. She was 18 two years ago.

Huft, 20, holds the fraternity responsible for her fall from a window on a third-story sleeping porch, which was 25-30 feet from the ground and suffering injuries when she hit a basketball court below the window. She said that too much alcohol led to her fall.

As a result, Huft is also seeking more than $10,000 in damages to pay for her medical costs incurred due to injuries, attorney's fees and emotional damage.

Huft also blames the fraternity for failing to install any safety measures such as window stops, lock guards or bars to prevent her fall.

However, the Moscow Police Department contradicts her lawsuit and alleges that Huft didn't fall out a window but fell from an upper bunk bed to the floor and fractured her pelvis and injured her ankle.

Police Lt. David Lehmitz said that she woke up on the basketball court."She wanted to go home," Lehmitz said. "She said that her back hurt and, once she got outside, she kind of collapsed. There was no evidence she fell out of a window."

In addition, Lehmitz also said that hospital officials claim that her injuries were probably from a 5- foot fall, not a 25 or a 30-foot fall. And the three-tiered bunk bed she was sleeping on was approximately five feet off the ground.

Next hearing is scheduled, Oct.7, before Latah County 2nd District Judge John Stegner.
